In a complex case led by Senior Counsel Sean Patel, Wood Smith Henning & Berman secured a voluntary dismissal of a class action lawsuit filed against one of the largest healthcare providers in Arizona following a third-party data breach.

The case arose after a contracted pathologist, providing pathology services at the client's cancer center, experienced a cybersecurity incident compromising certain patient data. Plaintiffs named both the pathologist and the health care provider as defendants, alleging liability for the data breach.

Through a detailed investigation and strategic negotiations, defense counsel demonstrated that the breach did not involve or compromise the health care provider's servers or internal systems. As a result, plaintiffs' counsel agreed that the health care provider bore no responsibility for the third party's data incident and voluntarily dismissed the claims against the client.

"This was an important win for our client and for health care providers generally," said Patel. "We were able to show that our client's systems were secure, and that responsibility rested solely with the third-party provider. It's a reminder that careful contractual and cybersecurity delineations can make all the difference in data breach litigation."

Managing Partner Chris Seusing added, "Our team continues to protect clients across the health care sector from evolving risks in data privacy and cybersecurity. This result reinforces our commitment to achieving efficient, well-reasoned outcomes that protect our clients' reputations and resources."

This outcome underscores the importance of distinguishing between direct and third-party data exposures in complex health care networks and highlights the defense team's effectiveness in resolving high stakes cybersecurity litigation without protracted court proceedings.
