The New York office successfully obtained a pre-answer dismissal of all third-party claims asserted against a moving company client, bringing the client's involvement in the litigation to an end before discovery even began.
The underlying negligence action arose from allegations that the plaintiff sustained personal injuries after tripping and falling on a raised sidewalk while working during the course of his employment. After the plaintiff filed suit against the property owner, the owner commenced a third-party action against the employer seeking common law indemnification and contribution.
Recognizing a dispositive legal issue at the outset if the case, WSHB moved to dismiss the third-party complaint before answering. The motion argued the third-party complaint failed to state a cause of action because the complaint did not allege that the plaintiff suffered a "grave injury", a prerequisite for maintaining common law indemnification and contribution claims against an injured workers' employer under New York Workers' Compensation Law.
The motion further demonstrated the third-party claims were independently barred by Workers' Compensation Law because the plaintiff's bill of particulars did not allege any grave injury and the third-party plaintiff asserted no contractual indemnification claims against the employer. In support of the motion, the defense submitted the plaintiff's pleadings, medical records, and the client's workers' compensation policy, establishing the client's entitlement to judgment as a matter of law.
Although the third-party plaintiff opposed the motion, it failed to appear for oral argument. Notwithstanding, the court granted the motion both on default and on the merits, expressly holding that the third-party complaint failed to state a cognizable cause of action as against Flatbush.
"This result highlights the importance of evaluating every case for dispositive opportunities from the very beginning," said Luke. "Rather than assuming a matter must proceed through length discovery, an early assessment of the applicable statutory defenses can identify avenues to eliminate claims outright, saving clients substantial time and litigation expense."
By identifying the threshold legal deficiencies in the third-party complaint and pursuing an aggressive pre-answer strategy, the defense secured a complete dismissal before the parties entered costly and time-consuming litigation, underscoring the value of early case assessment and strategic motion practice.
