The Dallas team of Wood Smith Henning & Berman achieved a decisive summary judgment victory on behalf of a nationwide restaurant chain in a premises liability action alleging negligence arising from a claimed slip-and-fall incident at the restaurant's entrance. The team was led by Dallas Managing Partner Christine Atwood and Senior Counsel Larissa Wakelin.

The plaintiff alleged he suffered significant injuries and damages after slipping shortly after entering the restaurant, asserting the premises were unsafe and improperly maintained. From the outset, the defense team conducted an exhaustive investigation and pursued targeted discovery designed to test the factual underpinnings of those claims.

The effort proved pivotal. During discovery, the team uncovered security camera footage capturing the moments surrounding the incident. The video showed a wet floor warning sign positioned near the restaurant entrance when the plaintiff first entered. The footage further revealed that after the fall, the plaintiff kicked the warning sign out of the way.

When confronted with the video evidence during his deposition, the plaintiff asserted he could not see the waning sign because of his height and complained the sign was not placed directly in his walking path.

Despite the well-known reluctance of Texas courts to grant summary judgment in premises liability cases, particularly where plaintiffs allege disputed facts, the court ruled in favor of the defense, bringing the case to a complete resolution.
