The Second Court of Appeals in Forth Worth affirmed a trial court order granting complete summary judgment in favor of a wedding venue owner. The ruling eliminated negligence claims seeking more than $1 million in alleged damages and reinforces important statewide principles governing premises-liability law.

The plaintiff alleged she sustained injuries from an unreasonably dangerous condition on a ballroom floor during a wedding reception. After full discovery, defense counsel strategically filed a targeted motion for summary judgment, challenging the plaintiff to present competent evidence showing that the condition at issue was measurably more likely to cause injury before the incident to establish foreseeability, an essential element under Texas law.

Defense counsel argued that, under recent Supreme Court of Texas guidance interpreting the Doctrine of Common Conditions, landowners are not insurers of their guests' safety and cannot be held liable for injuries airing from ordinary, broadly defined, or vaguely described conditions absent evidence of actual or constructive knowledge of an unreasonable risk.

The trial court agreed, finding the plaintiff failed to raise a genuine issue if material fact and that her evidence was insufficient as a matter of law. The Scend Court of Appeals affirmed the ruling in full, holding that the law does not permit plaintiffs to impose de facto strict liability on property owners by recharacterizing everyday conditions as inherently dangerous.

"This decision is an important reaffirmation that Texas courts continue to require meaningful evidence of foreseeability before sending premises liability claims to a jury," said Atwood. "The Doctrine of Common Conditions exists for a reason- to prevent liability based on speculation or oversight."

Premises liability claims cannot circumvent the strict limits of Texas foreseeability doctrine, nor can plaintiffs convert ordinary conditions into actionable hazards through broad generalizations.
