Wood Smith Henning & Berman is proud to announce that a decisive litigation strategy employed by Boca Raton partner, Sebastian Larrea and senior associate Nicole Dominguez, resulted in the dismissal with prejudice of a $1.75 million property damage lawsuit arising from Hurricane Ian, with no payment made by the firm's clients.
The plaintiff alleged substantial property damage purportedly caused by Hurricane Ian and sought recovery under their property insurance policy. Utilizing both applicable policy provisions and supporting case law, the defense maintained that no coverage existed for the claimed damages and that the lawsuit lacked legal and factual merit.
In response, the defense team prepared and served a motion for sanctions pursuant to Florida Statute §57.105, which permits sanctions against parties and counsel who pursue unsupported claims. Under the statute 21-day safe harbor provision, a party may avoid sanctions by withdrawing or dismissing the challenged claim.
Following service of the motion and subsequent discussions with plaintiff's counsel, the plaintiff voluntarily dismissed the lawsuit with prejudice before the expiration of the statutory period, bringing the matter to a complete and final resolution without any financial contribution from the defense.
