Wood Smith Henning & Berman is pleased to announce that Arizona Partner Jason H. Klein will serve as a panelist at the 2026 Claims and Litigation Management (CLM) Annual Conference, taking place March 25 – 27, 2026, at Walt Disney's Coronado Springs Resort in Orlando, Florida.  He will present on Thursday, March 26, 2026, at 2:00 p.m. as part of the panel titled, "Over the Line: Managing Construction Risks that Cross Property Lines."

Construction liability exposure can emerge long before a project breaks ground, and frequently extend well beyond the physical boundaries of the jobsite. Some of the most contentious disputes arise when owners of adjacent properties raise claims despite having no direct involvement in the project. Allegations can range from vibration-related damage to trespass, encroachment, and other impacts triggered by neighboring construction activity.

This session offers a practical and forward-looking discussion on how construction, design, and risk professionals can proactively identify and manage these off-site exposures form the outset. Panelists will examine the critical role of preconstruction planning, site assessments, monitoring protocols and communication strategies in minimizing downstream disputes.

"Adjacent property claims remain a challenging and unpredictable risk category in construction litigation," said Klein. "By fostering early collaboration among insurers, legal teams, and forensic experts, we can better anticipate issues, reduce exposure, and protect project stakeholders from significant financial and operational disruptions."

The panel will also explore how insurance, legal, and forensic experts can work together before and during construction to forecast potential cross-boundary impacts, implement protective measures, and strengthen the defensibility of claims should disputes arise.
