The case involved allegations of fraud and breach of contract against a residential home inspector following two pre-purchase inspections. Thanks to Hicks skillful trial strategy, compelling presentation of the evidence, and artful cross-examination, the court ruled entirely in favor of the defense, exonerating the firm's client on all claims.

The plaintiffs claimed that the inspector observed but failed to disclose evidence of a termite infestation and resulting damages during the inspections. Alternatively, they argued that if the inspector had not observed the infestation, the scope of the inspection should have identified the issue. Following mediation and negotiation attempts, the matter proceeded to trial.

At trial, the defense team presented a strategic combination of witness testimony and evidence that demonstrated the inspector's compliance with the scope of work outlined in the contract. The court concluded that "there was no credible evidence that the defendant made a material misstatement or withheld information with the intent to deceive the plaintiffs." The judge also found that there was no breach of contract or fraud.

Hicks attributed the outcome to the client's integrity and the team's preparation. "I could only present the client as a witness and ask him to testify truthfully. It was the calm, honest, and direct demeanor of our client, combined with his unwavering belief in the quality of his work, that carried the day," Hicks remarked.
