Overview
Brittany Borck is an accomplished trial lawyer focusing on complex commercial and general civil litigation matters in state and federal courts nationwide. Her representations frequently involve both individuals and corporations in securities fraud, fiduciary duty, class actions, and deceptive unfair trade practice claims. Brittany also handles securities litigation and securities regulatory matters and has experience in construction and bankruptcy matters.
Brittany routinely represents broker-dealers, registered investment advisors, registered representatives, insurance agents, and hedge funds throughout the United States in a wide array of customer and industry disputes in federal and state courts, as well as before the Financial Industry Regulatory Authority. She has substantial trial experience, including serving as second chair in several trials in which juries awarded verdicts favorable to the defense. On several occasions, Brittany has obtained awards dismissing Financial Industry Regulatory Authority actions at the motion-to-dismiss stage, including one for over S7 million.
Notably, Brittany is also responsible for creating a new law in Florida regarding an insurance carrier's ability to bring a legal malpractice claim against defense counsel retained to represent an insured. Arch Ins. Ca. v. Kubicki Draper, LLP, 318 So. 3d 1249 (Fla. 2021).
She clerked for Judge Joseph P. Farina of the Eleventh Judicial Circuit Court.
