(New York, New York) (January 27, 2025)- Wood Smith Henning & Berman announces a significant victory in a case involving a fraudulent accident at a work site. Senior associate, Megan McDonough, successfully secured a stipulation of discontinuance with prejudice after uncovering critical evidence that revealed false claims made by the plaintiff about an alleged workplace accident.

The plaintiff claimed to have been injured on the job. However, the employer denied both the employment relationship and the occurrence of any accident. In response, McDonough aggressively moved to amend the defense's answer to include a fraud claim. Following the plaintiff's deposition, which revealed significant inconsistencies in his account, plaintiff's counsel agreed to withdraw the action.

"Achieving this result was a testament to meticulous preparation and a steadfast commitment to uncovering the truth," said McDonough. "We not only developed a strong defense strategy but also leveraged key testimony to expose the plaintiff's fabrications, ensuring justice for our client."

Special recognition was given to senior counsel, Alexa Rissoff, whose skillful questioning during the plaintiff's deposition secured pivotal testimony. This evidence was instrumental in impeaching the plaintiff's credibility and strengthening the fraud defense.

Tracy Abatemarco, co-managing partner of the New York office, remarked, "This outcome exemplifies the exceptional level of legal advocacy we strive to deliver for our clients. The team demonstrated extraordinary skill and determination in navigating a complex case and achieving a decisive result."

With the stipulation of discontinuance with prejudice, WSHB has once again demonstrated its commitment to fighting and defeating the fraudulent claims currently running rampant in New York's legal system.
