Trial attorneys Andreea Custurea and Greg Amundson expertly navigated a multitude of claims brought forth by the plaintiffs, who alleged breaches of contract, fraud, and other serious offenses. WSHB successfully defended against claims exceeding $2 million with the court awarding the plaintiff less than $50,000. In addition, as the plaintiff failed to surpass the statutory offer to compromise and are now responsible for all expert fees and costs.
The plaintiff initially sought significant damages related to an undeveloped property, filing a comprehensive complaint with fourteen causes of action. However, through meticulous preparation and compelling arguments, Custurea and Amundson effectively dismantled the plaintiffs' case both during pre-trial motions and throughout the trial.
Ultimately, the court dismissed the majority of the claims against the defendants, highlighting the speculative nature of the plaintiff's assertions and the lack of supporting evidence. A key moment in the trial was the exclusion of the plaintiffs' sole damage expert, whose testimony was deemed speculative under the Sanchez ruling. Opting not to call their own cost estimating and economic expert, Amundson and Custurea underscored the plaintiffs' failure to substantiate their claims for damages.

The court further concluded that plaintiff, acting as the owner-builder of the property in question, was responsible for the project's changes and delays. Additionally, the court dismissed the fraud and intentional misrepresentation causes of action, affirming that there was no malice or fraud on the part of the law firm's client.
