Wood Smith Henning & Berman secured a significant defense victory in Michigan, obtaining summary disposition and dismissal with prejudice of a high-exposure premises liability action arising from an alleged slip and fall on black ice at an apartment complex.
The plaintiff, a tenant at the apartment complex owned and managed by WSHB's clients, alleged that he sustained severe ankle injuries when he slipped on black ice while walking to his vehicle. The injury required open reduction and internal fixation (ORIF) surgery. The plaintiff claimed past economic damages in the low six figures and sought substantial future damages based on a projected 50-year damages period. His counsel indicated that they intended to seek a seven-year figure award at trial.
The plaintiff's theory was that the icy condition resulted from the defendant's snow-removal efforts. Specifically, he contended that snow piles created during remedial work melted and subsequently refroze, creating the black ice on which he allegedly fell.
Partner John Stiglich and Detroit office managing partner Michael Spinazzola led the team, along with significant support provided by associate, Zachary Mittison. The defense team successfully demonstrated that the evidentiary record did not support the plaintiff's theory. Critically, the plaintiff acknowledged that freezing rain was actively falling at the time of the incident and conceded that the ice could have formed as a result of the ongoing winter storm.
Based on these admissions and the evidence developed during discovery, the defense argued that the clients did not breach any duty owed to the plaintiff because the alleged condition resulted from an ongoing winter weather event. The defense further established that the clients lacked actual or constructive notice of the specific icy condition before the incident.
The team also challenged the plaintiff's alternative theory that melting and refreezing snow piles caused the ice, arguing that the theory rested on speculation rather than evidence in the record. Without evidence establishing that the defendant's snow-removal activities created the condition, the plaintiff could not establish the necessary factual basis to impose liability. The Oakland County Circuit Court agreed with the defense arguments in full, granting summary disposition and dismissing the plaintiff's claims with prejudice.
"This was a significant outcome in a case involving substantial claimed damages and potential seven-figure exposure," said Stiglich. "The team focused closely on the plaintiff's own testimony and the evidentiary record, which demonstrated that his theory regarding the source of the ice was speculative. The court's decision reinforces the importance of requiring a plaintiff to establish each element of a premises liability claim with evidence rather than conjecture."

"Plaintiff could not establish that our client's snow-removal efforts caused the condition at issue, particularly in light of his own testimony regarding freezing rain occurring at the time of the incident. By developing that record through discovery, we were able to demonstrate there was no factual basis to allow the case to proceed to a jury."
