Wood Smith Henning & Berman is pleased to announce that Senior Counsel Lauren Nweze secured a complete defense verdict following a jury trial in federal court on behalf of police officers and their department in a high-exposure negligence case.

The lawsuit arose from an incident in which the plaintiff sustained burn injuries while under the influence of drugs inside his residence. The plaintiff alleged that responding police officers were negligent in failing to enter the home and prevent him from harming himself. He sought more than $18 million in damages at trial.

Lauren vigorously challenged both the factual and legal underpinnings of the plaintiff's claims, demonstrating that the officers acted reasonably and within the scope of their duties under the circumstances presented. After hearing the evidence, the jury rejected the plaintiff's allegations in full and returned a verdict in favor of the defendants.

"This case presented difficult and emotional facts, but the law is clear on the scope of an officer's duty under these circumstances," said Nweze. "We focused on ensuring the jury understood what the officers knew at the time and the reasonableness of their actions in that moment. We are grateful the jury carefully considered the evidence and reached a just result."

The result spared the officers and the department from significant exposure and reinforces the principle that liability cannot be imposed based on speculation or hindsight.

"This verdict reflects the jury's careful consideration of the facts and the applicable standards governing law enforcement conduct," said Portland Managing Partner Graham Miller. "We are proud to have defended the clients against claims that sought to impose liability where none existed."

Lauren's trial advocacy and strategic presentation of the defense were instrumental in achieving this outcome, which was well received by both the client and the carrier.
