Wood Smith Henning & Berman is proud to report that associate Kerstein Camilien secured two pre-answer dismissals on behalf of hotel and real estate entities sued in connection with an alleged elevator accident at a hotel in New York County. Utilizing two targeted motions under CPLR 3211(a)(7), Camilien obtained dismissal of the claims against the clients before they incurred the expense of answering the complaint and proceeding through discovery.

The plaintiff sued several defendants following the alleged accident, including entities that neither owned nor operated the property. After requests for voluntary discontinuance went unanswered, the defense moved promptly to address the legal deficiencies in the claims.

"Identifying each defendant's actual relationship to the property was critical to our approach," said Camilien. "We focused our motions strategically to show our clients were not the proper parties as well as arguing the allegations failed to establish a legal duty to the plaintiff."

The first motion sought dismissal on behalf of defendants identified only by trade names lacking a separate legal identity, as well as a franchisor that neither owned nor controlled the hotel or elevator. The defense argued that the trade names could not be sued as independent legal entities, and that the franchisor owed no legal duty to the plaintiff under the circumstances.

The second motion addressed claims against entities separate and distinct from the property owner. The defense established that those entities' corporate relationships did not supply a basis for imposing a duty to the plaintiff.

In opposition, the plaintiff challenged the motions as untimely because the original deadline to answer had passed, despite having stipulated to an extension. The plaintiff also sought additional discovery concerning the defendants'' corporate relationships and the hotel's operations. The defense rebutted those arguments in reply, and Camilien presented oral argument before the court. The court rejected the plaintiff's opposition and granted both motions.

"Early motion practice can make a substantial difference when a lawsuit names multiple entities without a sufficient basis for liability," said partner Nicole Aldridge-Henry. "These dismissals reflect a careful assessment of the parties and the pleadings, followed by a focused strategy that spared our clients the cost and disruption of continued litigation."

The result underscores the value of examining corporate identity, property ownership, and operational responsibility at the outset of a premises liability action. By addressing those issues before answering, the defense secured an early resolution for its clients.
