Wood Smith Henning & Berman is proud to share that Florida partners Craig Derrig and Ryan Schoeb and senior counsel Christina Hall secured a significant victory on behalf of a Miami Beach hotel and related entities, obtaining dismissal of all claims with prejudice in a wrongful death lawsuit arising from the drowning death of a guest of the hotel. The case involved a tragic set of facts, including the decedent's minor children having witnessed the drowning and being completely orphaned as a result. The litigation was complex and contentious, with excessive motion practice by the plaintiff, in addition to several multi-million-dollar demands.

Despite the heartbreaking facts surrounding the drowning and multiple responses in opposition filed by the plaintiff, the court granted the defense motion for dismissal with prejudice, resulting in a complete defense victory. The court agreed with the defense's argument that the hotel had no legal duty to warn its guests about naturally occurring conditions on the adjacent public beach.

"This case involved terrible facts and highly sympathetic plaintiffs, which made it crucial for us to develop a strategy for our clients to avoid trial, and to pursue that strategy relentlessly, despite numerous obstacles thrown at us by the plaintiff," said Schoeb. "Our team conducted discovery to narrow the issues before the court and presented strong legal arguments, which established that our clients did not have a legal duty to the plaintiffs. We are very happy with the court's decision."

In addition to numerous premises liability claims, plaintiffs also brought claims against the hotel for fraudulent advertising and negligent misrepresentation, based on information about the hotel that appeared online. The WSHB team pursued discovery, which revealed a lack of evidentiary support for those claims. In a strategic move designed to significantly narrow the issues on the motion to dismiss, the defense prepared a motion for sanctions under Florida Statute §57.105, forcing plaintiffs to dismiss all claims for fraudulent advertisement and negligent misrepresentation, leaving only the premises liability claims to be heard on the motion to dismiss.

Obtaining dismissal with prejudice is incredibly rare, but the case law was on the hotel's side, and the defense team spent significant time preparing for oral arguments at the hearing to ensure the court would see through the smokescreen of irrelevant facts and arguments presented by the plaintiffs. After three attempts at presenting a valid cause of action, defense argued that it was now obvious that further amendments of the complaint would be futile and that the hotel should not be required to endure additional expenditures of time and money in defending claims that the plaintiff clearly could not support.

The ruling highlights the importance of thorough, detailed research on threshold legal issues such as duty. The WSHB team presented case law highly specific to the particular facts, providing the court with a solid basis for dismissal. It also emphasizes the importance of discovery and strategic motion practice to narrow the issues as much as possible before a hearing on a dispositive motion.
