Wood Smith Henning & Berman successfully obtained a significant litigation victory in New Jersey after securing an order disqualifying plaintiffs' counsel in a series of 10 legal actions involving allegations sounding in products liability and premises liability against the Firm's trampoline park client.
The motions, which were consolidated and transferred to be heard before one judge, were briefed and argued on behalf of the defense by partners Jill Mucerino and Deborah Davison. The motions sought plaintiffs' counsel's disqualification based on plaintiffs' counsel's access to privileged and confidential defense materials and plaintiffs' retention of the defendants' former employee as an expert. Following extensive briefing and oral argument, the court granted the motions and entered orders disqualifying counsel and preventing counsel's further involvement in the actions in any capacity.
The court emphasized the seriousness of attorney disqualification, recognizing that such relief carries profound professional, reputational, and financial consequences, while also affecting a party's right to counsel of choice. For that reason, the judge noted that motions of this nature require painstaking factual and legal analyses. After undertaking that review, the court concluded disqualification was warranted and necessary to preserve the integrity of the proceedings.
"This decision underscores that the boundaries of privilege and work product are not aspirational—they are enforceable limits that define how litigation must proceed," said Mucerino. "Where those limits are exceeded, as was the case here, it is appropriate and necessary for the court to act to correct the imbalance and preserve confidence in the process."
The decision marks a notable victory and reinforces the judiciary's willingness to impose meaningful remedies where privileged and confidential legal materials are improperly accessed or used. The court, in reaching its decision, and recognizing its significance, cautioned "an individual who flies too close to the sun risks death" citing to the Greek myth of Icarus.
