In this case, the Plaintiff initiated a lawsuit against WSHB's insurance client asserting that their property insurance claim should not have been subjected to the appraisal process. The Plaintiff argued that the denial of the roof portion of the claim created a coverage question that was unsuitable for appraisal. Prior to litigation, WSHB's client invoked appraisal on all of the damages being claimed including the roof.

Through the appraisal process, the Umpire determined that there was no wind damage to the roof associated with the claim. Consequently, no insurance proceeds were awarded for the roof portion of the claim in appraisal. Leveraging Florida case law, WSHB asserted that the entire claim, including the roof, had been resolved through the appraisal process, thereby avoiding the need for judicial intervention.

To solidify their position, WSHB filed a Motion to Dismiss citing to Florida case law that supported the dismissal of the Plaintiff's meritless complaint.

Days before the scheduled hearing on the Motion to Dismiss, counsel for the Plaintiff voluntarily dismissed the lawsuit with prejudice.
