The case centered on a dramatic incident at an apartment complex, where a concrete stair structure allegedly collapsed beneath the plaintiff as he exited the property, pinning him for approximately 45 minutes until emergency responders arrived. The plaintiff claimed extensive injuries, including cervical and lumbar spine damage leading to four spine surgeries, a fractured pelvis, loss of consciousness, as well as ongoing pain, mental anguish, depression, and significant impairment to his daily life and earning capacity.
At mediation, the plaintiff demanded $11 million. The defense’s highest offer was $850,000. At trial, the plaintiff appeared before the jury using both a rolling walker with seat cushion and a cane, seeking $9 million in damages based on $521,000 in past medical expenses and asserted long-term life impacts.

After weighing the evidence, the jury returned a verdict of $525,000 with zero pre-judgment interest, a result that not only fell dramatically below the plaintiff’s demands but aligned squarely with the defense’s valuation and case strategy from the outset.
