In this complex case the opposing party sought to establish a new precedent in the field of lead paint litigation, as the plaintiff's counsel argued that the New York City "Turnover Provision" should serve as a predicate for liability. Additionally, the plaintiff alleged liability on the part of the premises owner and one of its principals, based on an uncontested Department of Health violation.
WSHB employed a robust legal strategy, utilizing expert testimony and compelling evidence to demonstrate that material issues of fact remained unresolved. They brought to light the possibility that the child may not have even sustained the alleged injuries, raising further questions about the plaintiff's claims. Crucially, they cast doubt on the assertion that the infant plaintiff's cognitive deficits and brain damage were caused by lead exposure in the apartment.
