Wood Smith Henning & Berman LLP (WSHB) is pleased to announce a significant victory obtained by Senior Counsel Arthur Rushforth, who successfully secured an order enforcing a settlement agreement in a contentious New York case involving a self-represented (pro se) plaintiff.

The case presented unique challenges, as the plaintiff—representing himself—attempted to renege on a settlement agreement negotiated by Rushforth. The plaintiff contended that he never agreed to sign the release that had been presented, objecting specifically to the inclusion of standard hold harmless provisions.

Despite these claims, the court found in favor of WSHB’s client.  Rushforth presented clear and compelling evidence in the form of email correspondence confirming the plaintiff’s agreement to the settlement terms, which proved dispositive. Based on this evidence, the court granted WSHB’s motion to enforce the settlement, affirming that a binding agreement had been reached.

“This decision highlights the importance of thorough documentation throughout the settlement process,” said Rushforth. “When dealing with pro se litigants—who may not follow conventional procedures and often rely on unreliable online advice or AI-generated arguments—maintaining a clear written record of all communications is absolutely essential.”
