Wood Smith Henning & Berman achieved a significant appellate victory before the U.S. Court of Appeals for the First Circuit, successfully defending a judgment on the pleadings in favor of its insurer client in a dispute concerning coverage for pregnancy-related employment discrimination claims and an underlying default judgment entered against the insured.
The appellant filed the First Circuit appeal following the district court's entry of judgment on the pleadings in favor of the insurer. The underlying dispute centered on whether a claims-made Directors and Officers Liability Policy issued to the claimant's former employer, affording Employment Practices Liability coverage for claims first made during the policy period, provided coverage for pregnancy-related discrimination claims asserted against the employer.
The district court concluded that the pleadings provided no basis for finding that the policy afforded defense or indemnity coverage as the claims were first made in an administrative charge filed prior to the policy period. Additionally, the claims filed in federal court during the policy period were related claims as defined under the policy. As such, the district court held there was no defense or indemnity coverage available as a matter of law and entered judgment in the insurer's favor. The appellant appealed that determination to the First Circuit.
Kate Adams argued the case before the First Circuit, defending the district court's coverage determination. During argument, Kate highlighted the relevant claims-made policy language and explained why the applicable policy provisions were not in conflict or ambiguous as argued by the appellant. The First Circuit agreed, preserving the favorable judgment in our client's favor.
"This was an important appellate result involving the application of claims-made policy language to a complex underlying employment dispute," said Adams. "The case required us to keep the focus where it belonged, on the timing of the underlying claims, the terms of the policy, the unambiguous policy language, and whether the pleadings could support the coverage being sought. We are pleased that the First Circuit upheld the favorable result for our client."
