(October 19, 2025)- Wood Smith Henning & Berman is elated to announce a favorable result secured by Senior Counsel Megan Michaud and Partner Kate Adams in a long-running case that was pending before the Office of Public Hearings (OPH) at the Commission on Human Rights and Opportunities (CHRO).
This matter arose from a complaint filed by a former employee who alleged various claims arising from discrimination and harassment based on her sex and gender identity expression. After years of litigation, including extensive witness testimony and cross-examination during a public hearing, the OPH rejected complainant's harassment claims, as well as the majority of complainant's discrimination claims. The OPH found by a preponderance of the evidence that the employer engaged in a violation of Title VII and awarded the complainant less than $7,500 in damages.
While the ruling included an adverse finding, the outcome represents a significant defense success. Most notably, the OPH rejected the bulk of complainant's claims, and the total award was far below both the complainant's prior demands, which exceeded $100,000, and previous settlement offers.
