Partner Melanie Thomas and Senior Associate Lisa Szyc obtained a complete defense victory in Clark County, Nevada, securing summary judgment against two plaintiffs in a negligence action arising from a collision involving a casino-owned limousine. The court's rulings resolved the essential elements of medical causation and damages, operating as a full adjudication on the merits.
The lawsuit arose after a limousine driven by an employee of a major Las Vegas casino allegedly struck the rear of the plaintiffs' vehicle. The plaintiffs asserted claims for negligence, negligence per se, negligent entrustment, negligent hiring, and respondeat superior.
The defense team focused on the plaintiffs' failure to timely disclose the evidence necessary to establish that the collision caused their alleged injuries as well as the proof required to support their claimed damages. Although the plaintiffs identified past medical expenses, they failed to provide the requisite medical expert support connecting those expenses and their alleged injuries to the accident.
"An accident alone does not establish that every claimed injury or medical expense resulted from it," said Thomas. "Our motions focused on the evidentiary gaps in each plaintiff's case and the absence of timely disclosed expert testimony needed to establish medical causation and damages."
The court found that the plaintiffs lacked evidence to create a question of fact for a jury on those essential elements. The disclosure deadline expired, and the plaintiffs' expert disclosures did not satisfy the applicable requirements of Nevada Rule of Civil Procedure 16.1. The defense also addressed the plaintiffs' damages disclosures. Their computations identified past medical expenses, but they lacked expert support to substantiate those claims and failed to disclose admissible evidence supporting another category of damages.
Since all of the claims were rooted in negligence, the failure to establish medical causation and damages was dispositive. The court granted the defense motions against both plaintiffs, resulting in a full adjudication on the merits.
"This result reflects the importance of examining expert disclosures and damages computations closely throughout discovery," said Szyc. "By identifying what the plaintiffs would need to prove at trial and comparing that with the evidence they actually disclosed, we were able to present a focused basis for resolving both cases before trial."
