Wood Smith Henning & Berman is proud to announce that Senior Counsel Jackie Macias, Senior Associate Lauren Davies, and Associate Erin Howlin successfully secured dismissal of all claims against their client, a referee, through a post-answer motion to dismiss in a case arising from an alleged sideline injury at a high school football game.

The plaintiff, who was volunteering as a line marker during the game, alleged that the referee instructed him to stand too close to the field of play, which purportedly resulted in injuries. The action was part of broader litigation involving multiple defendants. In a  related case previously brought against the high school, the court dismissed the claims under the doctrine of assumption of the risk, finding that the plaintiff voluntarily encountered the inherent risks associated with participation in and proximity to an athletic event.

Building on that earlier ruling, the defense team advanced a targeted legal strategy grounded in the doctrines of collateral estoppel and res judicata. The team successfully moved to have the motion transferred to the same judge who presided over the prior action. After considering the motion, the court agreed that the issues already had been litigated and determined in the earlier case, and granted dismissal.

Davies, who authored the motion, commented, "This outcome reflects the power of a well-crafted motion grounded in established legal doctrines. By focusing on the prior adjudication and the preclusive effect of that decision we were able to demonstrate that the claims against our client could not proceed."

Macias, who argued the motion, added, "Strategic motion practice can often resolve complex litigation efficiently when the legal framework supports it. We were pleased the court recognized that the issues had already been decided and that further litigation was unwarranted."

Howlin, who handled the case file, noted that the result delivered meaningful value to the client and insurer. The ruling underscores the importance of carefully evaluating prior proceedings and leveraging doctrines such as collateral estoppel and res judicata when parties attempt to relitigate issues that have already been decided.
