Philadelphia managing partner Kamela Devole and senior associate Danielle Pell obtained a significant early litigation victory after the United States District Court for the Eastern District of Pennsylvania granted their motion to dismiss all claims against the client at the pleadings stage.

The case arose from a January 2024 slip-and-fall accident in which the plaintiff asserted negligence claims against multiple defendants. Although the plaintiff filed suit before Pennsylvania's two-year statute of limitations expired, our client was not served until April 2026, well after the limitations period had run.

Recognizing the dispositive issue early on, the defense team moved to dismiss the claims, arguing that under Pennsylvania law, the timely filing of a complaint alone does not toll the statute of limitations. Rather, a plaintiff must also make a good faith effort to effect service within the applicable limitations period. The motion established that the plaintiff neither completed timely service nor alleged facts demonstrating the diligence necessary to preserve the claims. The attorneys further argued that removal to federal court and subsequent service could not revive an otherwise time-barred action.

In reply briefing, the defense team reinforced that Pennsylvania's tolling rules continued to govern after removal, that removal preserved all available statute of limitations defenses, and that neither 28 U.S.C. section 1448 nor Federal Rule of Civil Procedure 4(m) could resurrect claims that had already expired under state law.

The Court agreed, concluding that the statute of limitations defect was apparent on the face of the pleadings. Finding no allegation or evidence that the plaintiff made a good faith effort to effect service within the limitations period, the Court dismissed all negligence claims against our client. The Court further held that service completed after removal did not cure the time-barred claims.

"This decision underscores the importance of identifying procedural defenses early in litigation," said Devole. "A timely filed complaint is only part of the analysis. Plaintiffs must also exercise diligence in serving defendants, and when they fail to do so, Pennsylvania law provides a strong basis for dismissal."

It reinforces that statute of limitations and service defenses remain powerful tools for achieving efficient, early resolutions when the facts support them," added Pell.

The decision provides valuable guidance for litigants handling cases involving delayed service and reinforces that removal does not restart statutes of limitation or tolling periods. The ruling also strengthens the availability of early dispositive motion practice where plaintiffs fail to exercise the diligence required to preserve their claims.
