The lawsuit stemmed from an article alleging that a threat actor had breached the health care provider's systems and exfiltrated data. Relying on that information, plaintiffs filed suit before confirming whether they were among the individuals potentially affected by the alleged incident.

The WSHB team immediately engaged with opposing counsel and outlined key legal deficiencies in the lawsuit, most notably, the plaintiffs had not been identified as part of any notified population, eliminating the requisite injury-in-fact needed to maintain the claim. After reviewing the information and engaging in productive dialogue, plaintiffs' counsel agreed to voluntarily dismiss the matter before costly and time-consuming litigation ensued.
