Wood Smith Henning & Berman (WSHB) secured a significant victory in the United States District Court for the Southern District of Florida, where Partner Timothy Shea and Senior Counsel Sander Weiner obtained a dismissal with prejudice on behalf of the firm's client in a closely watched defamation action involving reposted social media content and the scope of immunity under Section 230 of the Communications Decency Act.
The plaintiff asserted claims for defamation and defamation by implication arising from the defendant's reposting of a viral third-party social media video that alleged domestic abuse. Plaintiff contended the defendant became legally responsible for the content by reporting the video on its website and social media platforms alongside editorial captions, tags, and branding.
WSHB argued the claims were barred under Section 230 because the challenged content originated from a third-party content creator and the defendant functioned as an interactive computer service provider protected by the statute. The defense further argued that the alleged additions to the reposted content did not materially contribute to any alleged unlawfulness.
The Court agreed and dismissed all claims with prejudice. In its ruling, the court held that Plaintiff failed to allege that the defendant materially contributed to the alleged unlawful nature of the content sufficient to defeat Section 230 immunity. The Court specifically held that alleged additions such as captions, tags, reporting activity, branding, and the use of "allegedly" did not transform the defendant into the creator or developer of the content.
"This ruling reinforces the broad protections afforded under Section 230 and recognizes the important distinction between creating unlawful content and engaging in protected editorial discretion involving third-party material," said Shea. "The court carefully analyzed the allegations and confirmed that reposting and contextualizing third-party content does not, without more, eliminate statutory immunity."
Weiner added, "The case presented important and evolving questions concerning online publisher liability and the limits of Section 230 immunity in the modern digital landscape.
