Environmental & Toxic Tort
Extensive experience in environmental and toxic tort litigation, including cases involving leaking underground storage tanks, perchloroetehylene (“PCE”) contamination associated with releases from dry cleaning operations into the soil or water, methyl tertiary butyl ether (“ MTBE”) contamination associated with releases from gas station operations into the soil and water, claims under the Comprehensive Environmental Revenue Compensation and Liability Act (“CERCLA”), clean-up orders relating to San Diego Bay from the San Diego Regional Water Quality Control Board, defense of benzene exposure cases and defense of condominium homeowners’ associations, apartment owners, property managers and construction project managers in cases alleging injuries from water intrusion and mold exposure.

Defense of insurance agents and brokers, real estate agents and brokers, mold remediation professionals, accountants and attorneys.

Insurance Coverage And Insurance Coverage Litigation
Extensive experience preparing opinions addressing issues such as "pre-tender" fees, "advertising injury," "absolute" pollution exclusions and mold exclusions. In the area of insurance coverage litigation, experience includes obtaining an order of partial summary judgment precluding recovery of over $28 million in "pre-tender" attorneys fees and costs.

Product Liability
Defense of manufacturers, distributors and retailers of products alleged to cause injuries and property damage, including personal water craft, forklifts, faulty bolts, hydraulic hoists, automobile "seat-back" failures, ephedra-containing diet supplements (e.g. Metabolife) and gadolinium-based contrast dyes used in MRI procedures.
